What this is
An index of injury to feelings awards, taken from judgments published on the
Employment Tribunal decisions register. It exists to answer one question quickly:
what have tribunals actually awarded in cases like this one? Filter by
the year the claim was presented, protected characteristic and Vento band, read the
tribunal’s stated reasoning where it gave any, and go to the judgment.
How it was built
Every judgment on the register was downloaded and searched for injury to feelings
awards. Candidate passages were then read by a language model running locally, which
identified the sum awarded, what the award was for, and the tribunal’s reasoning
on the level. Vento bands are calculated in code from the year the claim was
presented, not by the model. Above upper: more than the upper band limit for the year the claim was presented. Those awards are shown in their own
zone on the chart and are included when you choose the Upper band. Every figure was checked to appear in the judgment text
before being recorded. The index is refreshed as new judgments are published.
Combined sums
Some orders — often consent judgments in the largest cases — compensate
injury to feelings only as part of a single figure that also covers loss of earnings,
pension loss, interest or other heads. These are listed separately below the awards,
with the whole figure and what it covers, and are left out of every statistic because
the injury to feelings element cannot be isolated.
What it is not
It is not a verified dataset and nothing here should be cited. The figures are
extracted automatically. A tribunal may state an award several times in different
combinations — the award alone, the award plus interest, the award plus a
personal injury element — and the extraction does not always pick the right one.
Where a judgment looked ambiguous the row is marked Review; where the
tribunal named a band that disagrees with the recorded figure it is marked
Band check. Both are hidden or flagged rather than silently corrected.
A stratified sample has been checked by hand and errors were found. No general
accuracy rate is claimed, because none has been established. Treat every figure as a
pointer to a judgment you then read.
Judgments are read by software, not by a lawyer. There is no editorial selection and
no case note has been written by hand.
Other sources
For curated, citable case notes see Harvey Quantum on LexisNexis or the injury to
feelings checklist on Practical Law. Those are edited by lawyers and are the right
source for anything going into advice or a submission. This index is complementary:
it covers the whole register rather than a selection, which is what makes the
distributions meaningful.
